Welcome to Tripmetic. These Terms of Service and End User License Agreement ("Terms" or "EULA") constitute a legally binding agreement between you and Tripmetic ("we," "us," or "our") governing your access to and use of the Tripmetic mobile application, website (tripmetic.app), and any related services (collectively, the "Services").
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download or use the App.
1. Use of the Services
Tripmetic provides a suite of travel logistics and financial planning tools. You agree to use the Services only for lawful purposes and in accordance with these Terms.
- No Account Required: You are not required to create an account to use the basic features of the App. Your data is stored locally on your device.
- Prohibited Conduct: You agree not to reverse engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of the App. You may not use the App to engage in any fraudulent, abusive, or malicious activity.
2. Subscriptions and In-App Purchases
Tripmetic offers premium content and features that require an additional purchase via auto-renewing subscriptions or one-time in-app purchases.
- Auto-Renewing Subscriptions: If you purchase a subscription, payment will be charged to your Apple ID or Google Play account at confirmation of purchase. Your subscription will automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Pricing and Billing: The price and length of the subscription will be displayed at the point of purchase. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Cancellation and Management: You may manage your subscriptions and turn off auto-renewal by going to your Account Settings on the App Store or Google Play Store after purchase. Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
3. Informational Purposes Only (Disclaimer)
The financial, currency conversion, and budgeting features provided by Tripmetic are for general informational and planning purposes only.
- Not Financial Advice: We are not a bank, financial institution, financial advisor, or tax professional. The App does not provide professional financial advice.
- Accuracy of Exchange Rates: While we strive to provide accurate, real-time fiat and cryptocurrency exchange rates, we do not guarantee the absolute accuracy, completeness, or timeliness of this data. Rates may fluctuate, and cached offline rates may differ from live market rates. You should independently verify any critical financial figures before conducting actual transactions.
4. Scope of License and Intellectual Property
Subject to your compliance with these Terms, Tripmetic grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App for your personal, non-commercial use on a mobile device that you own or control, strictly in accordance with this EULA and the usage rules established by the Apple App Store or Google Play Store.
All content, features, and functionality of the Services, including but not limited to the codebase, design, UI/UX, logos, and graphics, are the exclusive property of Tripmetic and are protected by international copyright, trademark, and other intellectual property laws.
5. Third-Party Services and Links
Our Services may contain links to third-party websites or integrate with third-party APIs (e.g., currency market data providers). We do not control and are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your use of third-party platforms is subject to their respective terms.
6. App Store Specific Terms (Apple & Google)
The following terms apply specifically if you download the App from the Apple App Store or Google Play Store:
- Acknowledgment: You and Tripmetic acknowledge that these Terms are concluded between you and Tripmetic only, and not with Apple Inc. or Google LLC. Tripmetic, not Apple or Google, is solely responsible for the App and the content thereof.
- Maintenance and Support: Tripmetic is solely responsible for providing any maintenance and support services with respect to the App. You acknowledge that Apple and Google have no obligation whatsoever to furnish any maintenance and support services.
- Warranty: Tripmetic is solely responsible for any product warranties, whether express or implied by law. In the event of any failure of the iOS version of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever.
- Product Claims: Tripmetic, not Apple or Google, is responsible for addressing any claims by you or any third party relating to the App, including, but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
- Intellectual Property Rights: In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, Tripmetic, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Third-Party Beneficiary: You and Tripmetic acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of these Terms, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TRIPMETIC DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, BUG-FREE, OR COMPLETELY SECURE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRIPMETIC, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Data Loss and Device Upgrades
Because Tripmetic stores your itineraries, packing lists, and budgets locally on your device to ensure offline functionality, we are not responsible for any data loss that occurs if your device is lost, damaged, wiped, or if you uninstall the App. We recommend keeping independent backups of critical travel documents.
10. Legal Compliance (U.S. Embargoes)
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in California.
12. Changes to the Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of this page or via an in-app announcement. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms.
